Sean “Diddy” Combs scored a significant legal victory on Tuesday, Nov. 19, when a federal judge ruled that evidence obtained during a sweep of his jail cell cannot be used at his upcoming bail hearing. Judge Arun Subramanian also ordered the destruction of 19 pages of notes seized during the controversial recent sweep, which Diddy‘s attorneys argued violated his attorney-client privilege.
The music mogul, facing serious charges including sex trafficking, racketeering, and transportation to engage in prostitution, appeared in court without shackles—a decision granted by the judge after his defence argued that shackling could unfairly bias potential jurors.
Wearing a khaki jumpsuit, Combs appeared more composed than in previous appearances, greeting his legal team with hugs before the hearing. The hearing was prompted by a Monday night filing from Combs’ attorneys, who alleged “outrageous government conduct” and “due process violations” when notes detailing legal strategies were seized during a Bureau of Prisons sweep.
Defence attorney Marc Agnifilo called the seizure a direct breach of Combs’ rights, emphasizing the sensitive nature of the materials. “Everything in these pads are things we discuss—trial strategy, undermining witnesses’ credibility—everything,” Agnifilo told the court.
Prosecutors argued that the sweep was routine and unrelated to Combs’ case. Assistant U.S. Attorney Christy Slavik claimed that most of the notes were personal, citing birthdays and inspirational quotes. She emphasized that the case investigation remains active.
Despite these arguments, Subramanian sided with the defence, calling for the notes’ destruction and barring their use in court. Combs has been detained at the Metropolitan Detention Center in Brooklyn since his September arrest. Two prior bail requests were denied amid concerns about potential witness tampering. His third bail hearing is scheduled for Friday, Nov. 22.
Diddy is expected to start trial in May 2025, he recently celebrated his 55th birthday behind bars.
